Drug maker Valeant Pharmaceuticals has settled a lawsuit accusing the U. S. Department of Justice of conspiring with an Indian drug company and sending drugs to Indian patients to be shipped abroad. In the agreement, the U. Judicial Panel on Multidistrict Litigation said the drug company, which is based in Canada, was not subject to the provisions of the Trade-mark Patent and Trademark Act. The FDA said that the company violated the Trade-mark Act by sending the drugs to Indian patients. The suit accused the FDA of conspiring to influence the distribution of the drugs to the Indian patients by making the drugs available to other nations.
The lawsuit alleged that the FDA was engaged in “extraordinary conduct” by conspiring to send drugs to India through its own U. subsidiary, Pfizer, and by sending drugs to India through another U. subsidiary, Mylan. The suit also alleged that the FDA knew that the drug companies were making the drugs to treat erectile dysfunction and “to market the drugs to Indian patients.” The FDA said that the drugs were not approved and that the company’s actions were “largely illegal.”
A hearing is scheduled for Oct. 5. In a statement, Valeant said that the settlement comes in “direct response to the pending FDA request for additional evidence that the FDA had a legitimate business relationship with the drug manufacturers and was responsible for the distribution of the drugs to the Indian patients.” The company said that the FDA had notified the company to take all reasonable steps to prevent future incidents of fraud and misbranding, and it has been cooperating with the FDA and the Indian healthcare system. The FDA has not yet issued any warning about the drug’s safety or the risk of adverse effects.
